General Terms & Condition

⚠️ The German version of these Terms and Conditions shall prevail. The English version is for convenience only.

  1. Scope of Application

These Terms and Conditions apply to all contracts concluded between GMW Signature Journeys, represented by Gerald Meyer-Waeterling, registered as a business in Stockelsdorf/Germany under registration no. gew – 68 – 2025 – XX (hereinafter referred to as “organizer” or “agent”), and the customer.

A distinction is made between:
a) Package travel contracts pursuant to §§ 651a et seq. BGB (German Civil Code).
b) Contracts for individual tourist services (e.g. accommodation, rental cars, flights, excursions) which the organizer acts solely as an agent for.

The applicable regulations are specified in the contract, booking confirmation, and these Terms and Conditions.

  1. Conclusion of Contract

2.1 By submitting a booking, the customer makes a binding offer to conclude a travel contract with the organizer.
2.2 The contract is concluded upon receipt of the booking confirmation.
2.3 If the booking confirmation deviates from the booking request, it constitutes a new offer. This offer becomes binding if the customer expressly accepts it within the specified period or makes a down payment.
2.4 Bookings must be made in writing or in text form (e.g. by email).

  1. Payments / Customer Funds Protection

3.1 In the case of package travel, the customer will receive the statutory security certificate together with the booking confirmation. Payments may only be requested after delivery of this certificate.
3.2 The amount of the deposit depends on the advance payments required in each individual case (e.g. for flights, accommodation) and will be specified in the individual contract. Unless otherwise agreed, the deposit amounts to 20 % of the total travel price. The balance is due no later than 30 days before departure, unless otherwise agreed in writing.
3.3 For individual services, the payment terms of the respective service provider apply.

  1. Changes to Services

The organizer may make changes if they are insignificant and do not affect the overall nature of the trip. The customer will be informed immediately of any significant changes.

  1. Withdrawal by the Customer / Cancellation Fees

5.1 The customer may withdraw from the contract at any time before the start of the trip. Costs may, however, be incurred. As a general rule, the cancellation terms of the respective service provider (e.g. for flights, accommodation, events) shall apply.

For the organizer’s own service fees, as separately stated in the booking confirmation, the following cancellation charges apply:

  • up to 29 days before departure: 20 %
  • 22–28 days before departure: 40 %
  • 15–21 days before departure: 60 %
  • 8–14 days before departure: 80 %
  • 0–7 days before departure / no-show: 100 %

5.2 Deviating terms apply if expressly stated in the offer.

  1. Rebookings

Should the customer request changes after conclusion of the contract, the organizer will make every effort to accommodate this. However, there is no entitlement to rebooking. Any costs incurred as a result shall be borne by the customer. If rebookings reduce the organizer’s service fees, the cancellation charges pursuant to clause 5 shall apply to the difference.

  1. Non-Utilization of Services

If the traveler does not make use of individual travel services that were contractually available, no pro-rata refund will be granted. The organizer will attempt to obtain a refund of saved expenses from the service providers.

  1. Minimum Number of Participants / Group Accommodation

8.1 For trips or accommodations with a minimum number of participants, the organizer may withdraw from the contract up to 30 days before departure if this number is not reached.
8.2 In such cases, payments already made will be refunded within 14 days.
8.3 Deviations must be explicitly stated in the contract.

  1. Deficiencies / Customer Obligations to Cooperate

The customer must immediately report any deficiencies at the travel destination and request remedy. If this is culpably omitted or only reported after the fact, claims for reduction and compensation are excluded.

In the event of baggage loss, damage, or delay in connection with flights, the traveler must immediately file a Property Irregularity Report (“P.I.R.”) with the responsible airline.

  1. Third-Party Services

If the organizer arranges third-party services (e.g. excursions, sports activities), he is not liable for the proper performance of these services.

  1. Liability Disclaimer

The organizer is liable without limitation for damages resulting from injury to life, body, or health caused by intent or negligence.
For other damages, the organizer is only liable in cases of intent or gross negligence.
For damages that are neither bodily injuries nor caused intentionally or by gross negligence, liability is limited to the travel price.

The customer is obliged to inform the organizer prior to booking of any known health restrictions or special risks (e.g. chronic illnesses, limited mobility) that may be relevant to the performance of the trip. If such notification is culpably omitted, the organizer shall not be liable for resulting damages, unless caused intentionally or by gross negligence.

  1. Travel Insurance

12.1 Customers are strongly advised to take out travel cancellation/interruption insurance as well as insurance covering repatriation costs in case of accident or illness. Unless otherwise expressly stated, travel insurance is not included in the travel price.
12.2 If the organizer offers travel insurance, this is provided solely as an intermediary service. The insurance contract is concluded exclusively between the customer and the insurer. Claims must be made directly with the insurer.

  1. Withdrawal and Termination by the Organizer

13.1 The organizer may terminate the contract if the customer behaves in a manner that constitutes a serious breach of contract.
13.2 The claim to the travel price, in particular the organizer’s service fees, remains due, less any saved expenses and refunds from external providers.

  1. Passport, Visa and Health Regulations

The organizer will assist the customer to the best of his knowledge with questions regarding passport, visa, and health regulations. Compliance with all applicable requirements, however, is the sole responsibility of the customer. The customer must ensure timely compliance and obtain the necessary documents.

  1. Data Protection

Personal data will only be processed in accordance with the GDPR and passed on to service providers insofar as this is necessary for the execution of the contract.

  1. Governing Law and Jurisdiction

German law shall apply. Place of jurisdiction is the organizer’s registered business location.

  1. Consumer Dispute Resolution

The organizer is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
